Balloting Period Extensions

An unpublished case, Bel Air Ridge HOA v. Rosenberg, supports the position that boards of directors may extend the balloting period as needed to ensure that a sufficient number of voters cast ballots in connection with special assessments, CC&Rs restatements, and bylaws restatements. The case did not address extending the balloting process for the election of directors. While HOA Boards should check with their legal counsel, we believe it is reasonable for boards to extend ballot periods for the election of directors.
