Disputed HOA Elections

Disputed HOA elections can easily turn into a financial and legal disaster for a homeowner association. The most common reason HOA elections are disputed is the failure of the inspector of elections to strictly follow California election laws which are complex. Association boards must be absolutely certain to hire an inspector of elections that is highly experienced and that has never had an election challenged in court. If an election for directors is successfully overturned by a court, the court will rule that the so called directors are not directors and will require a proper election to be held . All actions by the so-called directors will be voided by the court creating a disaster.
