Recording the Election Results

After the Instructor of Elections tabulates the ballots at a meeting held to count the ballots cast by the members of a common interest development, he or she is required to prepare a written report and certification in order to satisfy California Civil Code Section 5120 (b). In accordance with California law, the Inspector of Elections must send the written report and certification to the board members who in turn, are to notify every member of the homeowner association.

The newly elected board must also memorialize the election results in meeting minutes in order to create a permanent record of the election. This is also required by law.
