Removal of Directors by the Board
(Not the Membership)
A board of directors of a homeowner association can remove a director by a majority vote under limited conditions:
- The director has been convicted of a felony,
- The director has been adjudged by a court to be of unsound mind , or
- The director has missed more meetings than allowed by the bylaws of the association.
In addition, a board can file a petition with the Superior Court requesting the court to remove the director for fraudulent or dishonest acts, or gross abuse of authority, or discretion in exercising authority.
